Responsible Person for Cosmetics
The European Regulation for Cosmetics, EC 1223/2009, states that “only cosmetic products, for which a legal or natural person is designated within the Community as “responsible person” shall be placed on the market.
A manufacturer located ouside of E.U. countries must appoint a responsible person and have a written agreement specifying the product and model name for which the service is to be provided.
For each cosmetic product placed on the market, the RP shall ensure compliance with the relevant obligations set out in the Regulation.
Responsible peson also have obligations to keep the product information file for the products placed on the EU market, for which he is acting as the RP at his address indicated on the product label.
If necessary, ROP must take any appropriate measures to bring the products into conformity, including product withdrawal or product recall.
RP must cooperate with the different EU competent authorities (there are mostly different ministries of health of different countries) at their request.
In the event of serious undesirable effect connected to the product, RP must notify the competent authority of the member state where the serious undesirable effect occurred.
